We, Post-Haste Performance and its associated names (www.ph-performance.ca, Post-Haste Performance), aim to give you the best possible value and service. The following Terms and Conditions will explain how we will deal with your order. By purchasing through this website you are entering into a legally binding contract with us. This means that you and we have rights and obligations. If you are unsure of your rights and obligations now or at any time during the contract please seek independent advice. The information on this website is given in good faith and Post-Haste Performance cannot accept responsibility for any loss or damage arising from the information or its use or misuse.
Post-Haste Performance does not endorse, nor recommend modification of vehicles for use in public highways, since warranty or government regulations may be violated. As an express condition of sale of any performance part, the buyer acknowledges and agrees to use the performance parts for the modification of vehicles in sanctioned OFF-ROAD competitive events only. While every effort is made to provide technical information and assistance, we have no control over owner installation, modification, and unusual and unknown stresses that performance parts are subject to. The buyer assumes all responsibilities for determining the suitability of the product. All aftermarket products should always be installed by professional shops only.
You are responsible for all activities which occur under your customer username and password, save where such activities occur as a result of our negligence or fault.
When you place your online order you are inviting us to enter into a contract with you to supply the goods you have selected at the price indicated on the website and in your order form. When we receive your order we will send you an acknowledgement by email to the address you have supplied to confirm receipt and we will pass your order to our sales team for processing. This acknowledgment is neither an order confirmation nor an order acceptance by us.
We may list availability information for goods sold by us on the website, including throughout the order process but cannot guarantee the availability of goods listed on the Website.
Acknowledgement of your Order is not a guarantee by us of the availability of the goods.
If you receive an acknowledgment email or confirmation email for an Order which you did not place, or if the details in the acknowledgment email or confirmation email do not match the Order which you placed, you must contact our customer services department Sales@PH-Performance.ca to cancel the order or correct the details.
We do our utmost to ensure that all our web prices and descriptions are accurate and up to date but on rare occasions it is possible that errors may occur. Our sales team will check the details of your order and if we find that there is a pricing or other error we will notify you as soon as possible and give you the choice to proceed with your order at the correct price/specification or to cancel your order and obtain a full refund. If we do not receive a response to this notification within seven days we will cancel the order and issue a refund of your payment.
Online payments may be made by PayPal. Payment using PayPal is taken at the time you place your order and is processed using PayPal’s independent company’s secure payment processing system. We do not see, or have access to, any of your payment card information.
Estimates as to delivery and/or installation dates are given in good faith but are only estimates and they are not guaranteed times and should not be relied upon as such. Time is not of the essence of the contract and we will not accept liability for any losses unless we fail to deliver within a reasonable time.
Please check that the goods you receive are the ones you ordered, the correct colour and size, and that they are examined for apparent faults or damage at the time of delivery and before installation/assembly. If on inspection you have any doubts please contact us immediately. In all cases genuine complaints will be dealt with in good faith, but your rights may be adversely affected if you do not contact us as soon as possible.
Authorization to return any and all products must be obtained by the Buyer from Post-Haste Performance in advance and must be made within (5) days of receiving the product. All returned products to Post-Haste Performance are subject to 25% restocking fee. All products which are approved for return are for store credit only. All products returned for credit must be in the same condition as it was originally delivered by Post-Haste Performance to the Buyer. Only the original Buyer may request for a return of products. All warranty cards and other such items must be included with the product being returned. Defective items may be exchanged for the same item only, and only after warranty has been cleared from original manufacturer will the Buyer receive product back. After receipt of goods, Post-Haste Performance shall inspect the goods to determine the exact quantity and condition of goods received. If Post-Haste Performance does not accept the goods as being defective and/or returnable for any reason, Buyer must accept all incurred costs. Special Orders, Custom Orders, and all Electrical or Mechanical parts are not returnable unless found defective.

Post-Haste Performance collects information that is necessary only to process an order. All orders are processed through PayPal. All account information collected on this web site is stored on PayPal’s secure site and is not available to the Post-Haste Performance computers, other than shipping and email information.
This web site contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.
IP Address Logging
Post-Haste Performance web servers collect domain names and/or IP addresses of users to measure what pages and features are accessed by our visitors. Post-Haste Performance uses software such as Web Trends to collect and analyze this information. This information helps us administer the site, improve content and gather broad demographic information for aggregate use Post-Haste Peroformance links IP addresses to personally identifiable information submitted to Post-Haste Performance. This information is used to verify whether a visitor has opted in to receiving additional information from Post-Haste Performance.
Post-Haste Performance is under no obligation to monitor the conduct of its website users, but it may investigate and respond if violations are reported. Post-Haste Performance reserves the right to delete, remove or exclude any listing or information, in its sole discretion, that does not meet its intent and guidelines for the services offered on the website.
